NOVEL ASPECTS OF THE PROPOSED AFRICAN PRINCIPLES ON THE LAW APPLICABLE TO INTERNATIONAL COMMERCIAL CONTRACTS
Abstract
The proposed African Principles on the Law Applicable to International Commercial Contracts are mainly based on the Rome I Regulation on the Law Applicable to Contractual Obligations and the Hague Principles on Choice of Law in International Commercial Contracts. However, this lecture will focus on the original and novel aspects of the African Principles. The following aspects will be discussed: partial and multiple choice of law; choice of non-State law; tacit choice of law; battle of forms in choice of law; substantive-law influence; overriding mandatory rules; and damages. It will be suggested that some of the novel formulations in the African Principles may be considered in future national, regional, supranational and international codifications of private international law of contract.
