THE LIABILITY OF EU MEMBER STATES FOR BREACHES OF EU LAW COMMITTED BY NATIONAL COURTS: THE RECEPTION OF THE PRINCIPLE BY THE GREEK SUPREME COURTS
Abstract
One of the most interesting examples of jurisprudential developmentand harmonisation of national law rules is that of the recognition andstructuring of the liability of EU Member States for breaches of EU law,with the identification of the principle in the Francovich decision andits deepening with the Köbler decision which set the conditions forliability for acts of the judicial bodies of the Member States. TheKöbler judgment was the subject of extensive commentary bylawyers from almost all Member States, Greece included. In effect,the fact that the Greek constitutional order does not provide forliability for acts of the State’s judicial bodies, the Greek supremecourts faced this principle with hesitation and went through differentstages of case law until settling on a specific position. The lecture willfocus on this “journey” of the Greek supreme courts’ case law until itsrecent status.
